TERMS OF SERVICE — FFUTUWWA CLWB
OVERVIEW
Welcome to Ffutuwwa Clwb (“Ffutuwwa”, “we”, “us”, “our”). We operate this website and booking store (the “Services”) to let you discover, book and participate in our activities — including weekly classes/sessions (e.g., wrestling, cycling and related active classes), drop-ins subject to capacity, and organised activity trips in the UK and abroad (e.g., hikes, treks, cycling tours) (collectively, the “Activities”). Our store is powered by Shopify.
These Terms of Service (the “Terms”) explain your rights and responsibilities when using the Services and participating in our Activities. They include important information about health & safety, risk, cancellations, and liability, so please read them carefully.
By visiting, booking, or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, do not use the Services.
SECTION 1 — ACCESS, ELIGIBILITY & ACCOUNT
1.1 Minimum Age & Consent. You represent that you are at least the age of majority in your UK jurisdiction (18 in England & Wales) or have parental/guardian consent.
1.2 Minors. Some Activities may allow under-18s with a parent/guardian present or written consent, subject to our Safeguarding & Supervision rules (see Section 13). Age restrictions appear on each Activity page.
1.3 Account Security. You’re responsible for your account and bookings made under it. Don’t share login credentials.
1.4 Accurate Information. Provide true, current, and complete details for registration, bookings, and health declarations.
SECTION 2 — NATURE OF OUR ACTIVITIES & HEALTH DECLARATION
2.1 Inherent Risks. Our Activities involve physical exertion and may include risks of injury, illness, falls, collision, altitude exposure, adverse weather, terrain hazards, road traffic (for cycling), and equipment failure. By participating, you acknowledge and accept these inherent risks.
2.2 Medical Fitness. You confirm you are medically fit to take part, will disclose relevant medical conditions, medications, or injuries during booking/check-in, and will follow coaches’/leaders’ instructions.
2.3 Personal Responsibility. You are responsible for assessing your own ability for each Activity, bringing required kit, staying hydrated/nourished, and using suitable personal protective equipment (e.g., helmet for cycling).
2.4 Alcohol/Drugs. Participation under the influence of alcohol, illegal drugs, or impairing medication is prohibited. We may refuse participation without refund.
SECTION 3 — BOOKINGS: CLASSES, SESSIONS & DROP-INS
3.1 Booking Options. You may pre-book weekly sessions via the website or attend as a drop-in if space allows. Capacity is limited; entry is first-come, first-served.
3.2 Check-In & Late Arrival. Arrive in time for the safety briefing/warm-up. Late arrivals may be refused entry to protect participant safety; no refund if refused for lateness.
3.3 No-Shows. If you do not attend a booked session, the fee is non-refundable.
3.4 Class Changes. We may change instructors, venues, or class formats where reasonably required (e.g., facility issues or staff illness).
SECTION 4 — EVENT TRIPS (UK & INTERNATIONAL)
4.1 Trip-Specific Terms. Each trip (e.g., trek, cycling tour, international hike) has a trip page and info pack with fitness requirements, kit list, inclusions/exclusions, payments, and cancellation schedule. Those terms are incorporated here.
4.2 Leader Authority. During trips, you agree to follow the lawful and reasonable instructions of our leaders/guides. They may remove anyone whose behaviour poses a risk, materially disrupts the group, or breaches local laws/safety rules, without refund.
4.3 Minimum Numbers & Itinerary Changes. Trips may have minimum numbers. We may cancel if not met, offering transfer or refund. Itineraries may change for safety, weather, or local conditions.
4.4 Travel Documents & Health. You are responsible for passports, visas, vaccinations, and entry requirements.
4.5 Insurance (Mandatory for Overseas Trips). Comprehensive travel insurance covering medical expenses, activity participation, personal accident, evacuation, cancellation/curtailment and baggage is mandatory for international trips. Proof may be requested.
4.6 Rooming & Conduct. Shared accommodation may be used. Respect fellow participants and local communities; quiet hours may apply.
4.7 Third-Party Suppliers. Transport, accommodation, guiding or equipment may be supplied by third parties who operate under their own terms and liability.
SECTION 5 — FUNDRAISING CHALLENGES
5.1 Charity Partners. Some trips are run as fundraising challenges. Minimum fundraising targets, deadlines, and Gift Aid requirements will be stated on the event page.
5.2 Use of Funds. Donations are processed via our nominated platforms or the partner charity’s platform under their terms and fundraising regulations.
5.3 Sponsorship & Transparency. Where participant fees cover trip costs, we will state this. You must be transparent with sponsors about how funds are used.
SECTION 6 — PRICES, BILLING & MEMBERSHIPS
6.1 Prices & Taxes. Prices are shown at checkout and may change. Unless stated otherwise, prices include applicable UK VAT (if registered) but exclude extras (e.g., equipment hire).
6.2 Payment. You agree to provide accurate payment details and authorise charges for bookings, memberships, or passes.
6.3 Memberships/Passes (If Offered). Any class packs, monthly passes or memberships will have their own terms (start date, renewal, freeze policy, transferability). We may suspend access for unpaid or disputed balances.
SECTION 7 — CANCELLATIONS & REFUNDS
7.1 Classes/Sessions (You Cancel).
• Cancel ≥ [24/48] hours before start: full refund or credit.
• Cancel < [24/48] hours or no-show: no refund.
7.2 Classes/Sessions (We Cancel). If we cancel, you may choose a refund, credit, or transfer.
7.3 Trips (You Cancel). Trip deposit is typically non-refundable. Further staged cancellation charges apply per the trip page (e.g., ≥60 days: loss of deposit; 59–30 days: 50%; <30 days: 100%). Substitute participants may be allowed subject to supplier terms and any admin fees.
7.4 Trips (We Cancel). If we cancel a trip (e.g., low numbers or force majeure), you may receive a refund or transfer/credit; we’re not responsible for incidental costs (e.g., personal gear, independent travel).
7.5 Force Majeure. We are not liable for delays/cancellations caused by events beyond our reasonable control (e.g., severe weather, strikes, pandemics, government action).
SECTION 8 — EQUIPMENT & FACILITIES
8.1 Your Equipment. You are responsible for your personal equipment. For cycling, helmets are mandatory. For wrestling/active classes, suitable attire and protective gear are required.
8.2 Hire & Damage. Hired equipment must be returned in the same condition. You may be charged reasonable costs for loss or damage (fair wear and tear excepted).
8.3 Valuables. Lockers/storage may be unmonitored; items are left at your own risk.
SECTION 9 — PHOTOS/VIDEO & MEDIA CONSENT
We may capture photos/video for training, safety, or promotional purposes. By attending, you consent to incidental inclusion. If you prefer not to be featured in marketing, please tell staff at check-in and email info@ffutuwwaclwb.com so we can flag your preference. We will use best efforts to honour reasonable requests.
SECTION 10 — CONDUCT, SAFEGUARDING & COMMUNITY STANDARDS
10.1 Respectful Behaviour. No harassment, abusive language, intimidation, discrimination, or unsafe conduct.
10.2 Safeguarding. We follow UK safeguarding principles. Report concerns to staff immediately. Some venues may use CCTV.
10.3 Bans & Suspensions. We may suspend or remove participants for serious or repeated breaches without refund.
SECTION 11 — SHIPPING & DELIVERY (MERCH/PHYSICAL GOODS)
For any merchandise purchased via our store, delivery estimates are not guaranteed. Risk passes to you when goods are handed to the carrier.
SECTION 12 — INTELLECTUAL PROPERTY
All content in our Services is owned by Ffutuwwa or our licensors. Personal, non-commercial use only. No copying, scraping, or republication without consent.
SECTION 13 — OPTIONAL TOOLS & THIRD-PARTY LINKS
We may provide third-party tools or link to third-party sites. Use is “as is” and at your own risk under those providers’ terms.
SECTION 14 — RELATIONSHIP WITH SHOPIFY
[Per Shopify’s note, unchanged.] Our store is powered by Shopify. Your sales/transactions are with Ffutuwwa Clwb, not Shopify. You release Shopify from claims related to your purchases with us.
SECTION 15 — PRIVACY & DATA (UK GDPR)
We process personal information under our Privacy Policy [LINK] in line with UK GDPR and the Data Protection Act 2018. We share limited data with Shopify and trusted processors to deliver the Services. Health information provided for safety is processed on a necessity basis and retained only as needed. SECTION 16 — FEEDBACK & CONTENT YOU PROVIDE
If you submit reviews, ideas or content, you grant us a licence to use them for operating and promoting the Services, and you confirm you have the necessary rights.
SECTION 17 — ERRORS & CHANGES
We may correct errors or update information (including schedules and prices) at any time.
SECTION 18 — PROHIBITED USES
No unlawful, abusive, unsafe, or disruptive use of our Services or Activities. No impersonation, scraping, spamming, or security circumvention.
SECTION 19 — HEALTH & SAFETY DISCLAIMER (CLASSES/SESSIONS)
Except where prohibited by law, you participate at your own risk and agree to follow briefings and instructions. Our coaches/leaders may adapt or stop your participation if they reasonably believe it’s unsafe.
SECTION 20 — TRIPS: PACKAGE TRAVEL REGULATIONS
20.1 When PTR Applies. If your booking amounts to a “package” under the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTR 2018”), you will receive pre-contract information and protection benefits required by law.
20.2 When PTR Does Not Apply. If we act solely as an agent for a single principal supplier, or your arrangements do not constitute a package, PTR 2018 may not apply. Trip pages will state the capacity in which we act.
SECTION 21 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ffutuwwa and our staff, leaders, contractors and suppliers will not be liable for indirect or consequential loss. Our total liability arising from any booking is limited to the amount you paid for that booking, except for liability that cannot be limited/excluded by law (e.g., death or personal injury caused by our negligence, fraud, or statutory rights under consumer law).
SECTION 22 — INDEMNITY
You agree to indemnify us against claims arising from your breach of these Terms or your negligent or unsafe conduct during Activities.
SECTION 23 — TERMINATION
We may suspend or terminate access for safety, non-payment, or breach. Terms that by nature survive, do so (including IP, liability, indemnity, governing law).
SECTION 24 — GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction, without affecting your statutory consumer rights.
SECTION 25 — CHANGES TO TERMS
We may update these Terms. Material changes will be notified in line with applicable law. Continued use after the effective date constitutes acceptance.
